Lecture & Domus Dinner – “Is increased risk the same as material contribution to injury? Causation in medical claims”
Lecture followed by questions and Domus dinner (mixed seating plan with members of the Bench and Bar).
At this qualifying session the speaker will talk about causation in clinical negligence and personal injury claims, in particular the so-called doctrine of ‘material contribution to injury’ (MCI). Caroline will discuss examples of how the courts have applied MCI, to see if there is a clear test that lawyers and doctors can understand and apply. She will consider whether there remain any unresolved questions,

The aims are to provide a user-friendly introduction to this deceptively complex problem; and to propose a practical analysis of how it should work.
